These Terms of Service ("Terms") govern your access to and use of betterhomestudio.co and any page hosted on it (the "Site"), and your communications with us, including our text messaging programs. The Site is operated by Better Home Studio LLC ("Better Home Studio," "we," "us," or "our"). By accessing the Site, submitting information through it, or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use the Site.

Our Services

Better Home Studio LLC is a marketing studio. We provide branding and strategy, content creation, and growth services, including paid advertising and sales enablement, for our own business and on behalf of the brands and properties we market. Some pages on this Site present a specific brand or property that we market, such as Avila Mall (410-430 E Sample Rd, Pompano Beach, FL 33064). When you contact us through one of those pages, you are communicating with Better Home Studio LLC acting on behalf of that brand, and these Terms apply to that communication.

Text Messaging (SMS) Program

We operate text messaging (SMS/MMS) programs for our own business and on behalf of the brands and properties we market. By opting in, you agree to the following.

• ·Consent: we send text messages only after you provide express written consent, by selecting an optional consent checkbox in the chat widget or on a form on this Site. Consent is separate and optional, and is never combined with any other agreement.
• ·Not a condition: consent to receive text messages is not a condition of any purchase, lease, or service.
• ·Message content: depending on the program, messages may include replies to your inquiry, appointment and tour scheduling, follow-up, and marketing or promotional messages such as offers, availability, and announcements.
• ·Message frequency: frequency varies and depends on your conversation with us. We do not commit to a fixed number of messages per month.
• ·Cost: message and data rates may apply. These are charged by your mobile carrier, not by us.
• ·Opting out: reply STOP to any message to stop receiving texts. You will receive a single confirmation and no further messages from that program.
• ·Help: reply HELP to any message for assistance, or contact us at hello@betterhomestudio.co.
• ·Your mobile information: we do not sell, rent, or share your mobile phone number or your SMS consent with third parties or affiliates for their marketing or promotional purposes. Your number is shared only with the vendors that operate the messaging on our behalf, such as our CRM and messaging platform (HighLevel/LeadConnector) and the telecom carriers required to deliver the message.
• ·Carrier liability: mobile carriers are not liable for delayed or undelivered messages.
• ·Eligibility: you must be at least 18 years old and the account holder or authorized user of the mobile number you provide.
• ·Supported carriers: message delivery depends on your carrier and is not guaranteed on every network.

Accuracy of Information You Provide

You agree to provide accurate and current information when you contact us, and to provide a mobile number that belongs to you or that you are authorized to use. If your number changes or is reassigned, please notify us or reply STOP so we do not message the new holder.

Property and Leasing Information

Information about properties presented on this Site, including availability, square footage, rent, common area maintenance charges, zoning, parking, and demographic figures, is provided for general information only. All figures are approximate and subject to change or withdrawal without notice, and do not constitute an offer, a lease, or a binding commitment. Any lease is governed solely by a written agreement signed by the parties.

Acceptable Use

You agree not to use the Site to:

• ·Violate any applicable law or regulation.
• ·Submit false, misleading, or fraudulent information, or impersonate another person.

To the fullest extent permitted by law, Better Home Studio LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Site or our messaging programs. Indemnification

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms at any time. The revised version takes effect when it is posted on this page, and the "Last updated" date above will change. Your continued use of the Site after that date means you accept the revised Terms. If we make a material change to our text messaging program, we will obtain new consent where required.
